At the time of the accident, he was working on an erected scaffold at a location that was below the level of the roof of the unfinished building. A cement block had been placed on a blue tarp on the roof; when a gust of wind blew the tarp upwards off the roof, it sent the cement block up into the air and down on the plaintiff's head and shoulder.
